CAPACITY Facility Services – Terms & Conditions
Effective Date: May 19, 2026
Welcome to CAPACITY Facility Services (“Company,” “we,” “our,” or “us”). By scheduling, approving, or utilizing our services, the customer (“Customer” or “Client”) agrees to the following Terms & Conditions.
1. Services Provided
CAPACITY Facility Services provides commercial cleaning, restroom sanitation, facility hygiene, surface disinfection, floor care, and related facility support services for commercial properties.
Services may include:
• Restroom sanitation and hygiene services
• Electrostatic disinfecting
• High-touch surface disinfection
• Tile and grout cleaning
• Commercial floor care
• Kitchen and food-prep sanitation
• Restroom consumable support including soap systems, paper products, urinal screens, odor control products, and related hygiene supplies
All services are commercial-only unless otherwise agreed in writing.
2. Scheduling & Access
Customer agrees to provide safe and reasonable access to the service location during scheduled service times.
If service cannot be completed due to restricted access, unsafe conditions, locked facilities, or delays outside of Company control, additional charges may apply.
After-hours scheduling may be available upon request.
3. Pricing & Billing
Pricing is based on:
• service frequency
• facility condition
• square footage
• labor requirements
• supply usage
• scope of work
Invoices are due according to the payment terms outlined in the service agreement or invoice.
Late payments may result in:
• service suspension
• late fees
• collection activity
• legal recovery costs where permitted by law
Returned payments or declined transactions may be subject to additional fees.
4. Service Changes
Additional services requested onsite or outside the agreed scope of work may result in additional charges.
Company reserves the right to adjust pricing if:
• service conditions materially change
• square footage changes
• frequency changes
• excessive buildup or contamination exists
• Customer requests expanded service scope
5. Cancellation Policy
Customers requesting cancellation or rescheduling should provide at least twenty-four (24) hours notice.
A cancellation fee may apply for missed appointments, denied access, or short-notice cancellations.
Recurring service agreements may require written notice for termination as outlined in the signed service agreement.
6. Service Limitations
While CAPACITY Facility Services utilizes professional cleaning and disinfecting methods, no cleaning or disinfecting process can guarantee complete elimination of all microorganisms, viruses, bacteria, or contaminants.
Disinfection reduces microorganisms on treated surfaces but does not guarantee illness prevention.
Results may vary depending on:
• facility conditions
• traffic levels
• maintenance between visits
• environmental factors
7. Customer Responsibilities
Customer agrees to:
• maintain a safe work environment
• disclose hazardous conditions
• secure sensitive items
• provide access to utilities when necessary
Customer is responsible for notifying Company of any concerns within a reasonable timeframe following service completion.
8. Limitation of Liability
To the fullest extent permitted by law, CAPACITY Facility Services shall not be liable for indirect, incidental, special, or consequential damages.
Company liability for any claim relating to services provided shall not exceed the amount paid for the specific service giving rise to the claim.
9. Consumables & Facility Support Products
Where applicable, Company may provide or coordinate restroom consumables and hygiene-related products including:
• toilet paper
• paper towels
• soap systems
• urinal screens
• odor control products
• hygiene consumables
Availability, pricing, and replacement schedules may vary.
10. Governing Law
These Terms & Conditions shall be governed by the laws of the State of Texas.
